Adopted

Permanent version

Effective for FreeWIS native v1 in the United States · Adopted September 16, 2026.

This End-User License Agreement ("Apple EULA") is between the individual who downloads or uses the Apple-distributed FreeWIS application ("you") and Hudson Consulting and Training, LLC, a Colorado limited liability company ("HCT"). It applies to the FreeWIS application identified in App Store Connect as bundle ID com.freewis.app, including an approved update that does not carry a replacement license (the "Licensed Application").

The initial release covered by this Apple EULA is specified as a free download through the United States App Store, for PLAY only. PLAY's AI assistant is available inside the PLAY demonstration. Standalone CHAT remains a separate browser-only service and is not included in this native release. No paid CHAT is offered in the first release. ## Plain-language summary

1. Apple is not a party to this Apple EULA. HCT, not Apple, provides and is responsible for the Licensed Application and the hosted FreeWIS services. 2. The initial public application is a free United States download for adults to access synthetic PLAY, including PLAY's AI assistant. Standalone CHAT is browser-only and is not included. Never put real child-welfare case or personal information into PLAY content. 3. The AI assistant is AI, can be wrong, does not provide professional advice and must not be used for real-case decisions or emergencies. 4. The FreeWIS Terms and PLAY Agreement presented for acceptance, and the acknowledged Privacy Notice, govern hosted PLAY through the application. A download is not a service acceptance or a purchase. 5. HCT may protect the hosted service with rate limits, WAF, bot prevention and access controls and may restrict or end access for violations. 6. GET source licensing and an Agency's production deployment are separate and are not governed or priced by this public-client Apple EULA.

1. Apple acknowledgement and responsibility

HCT and you acknowledge that this Apple EULA is concluded between you and HCT only, not with Apple Inc. ("Apple"). HCT, not Apple, is solely responsible for the Licensed Application and its content, subject to the agreements and law that apply. Nothing in this Apple EULA creates an obligation for Apple beyond Apple's own applicable terms.

HCT acknowledges that it has had the opportunity to review the Apple Media Services Terms and Conditions applicable as of this Apple EULA's effective date. HCT and you acknowledge that Apple's applicable Usage Rules govern the permitted scope of App Store use. The license below is limited to uses permitted by those Usage Rules and does not create conflicting usage rules.

2. Limited license

HCT grants you a personal, limited, revocable, nonexclusive, nontransferable license to install and use the Licensed Application on Apple-branded products that you own or control, as permitted by Apple's Usage Rules. The Licensed Application may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing as permitted by Apple's applicable Usage Rules. Each person's access to hosted PLAY remains subject to individual eligibility, sign-in, admission and service-specific acceptance. Those hosted-service requirements do not narrow Apple-permitted installation or use of the application client.

The license is for the application client. It does not transfer ownership, source code, repository/build/deployment access, restricted materials, an Agency license or a right to operate an Agency production system. Except where law or applicable open-source terms permit otherwise, you may not copy, redistribute, sublicense, sell, lease, reverse engineer, disassemble, attempt to derive source code from, modify or create derivative works of the Licensed Application.

3. Hosted service and document priority

The Licensed Application connects to HCT-hosted PLAY, including the AI assistant used within PLAY. The versioned FreeWIS Terms of Service presented for and accepted with that access govern hosted PLAY and use through the client. The Privacy Notice describes HCT's information practices and is acknowledged rather than incorporated as a contract. The PLAY Agreement applies to entry into PLAY.

The common Terms and Privacy Notice also describe services outside this release. Their discussion of standalone CHAT does not make it accessible through the Licensed Application or grant a native CHAT entitlement. Standalone CHAT remains browser-only and subject to its separate access requirements.

This Apple EULA controls a conflict about the Licensed Application's binary, installation, Apple distribution, Apple relationship or local use. The service-specific Agreement controls a conflict about its named service. The Terms control other hosted-service subjects. A purchase schedule controls its identified price, billing, renewal, cancellation, refund and entitlement subject. No document silently amends GET or an executed Agency agreement.

4. Eligibility and account

You must be at least 18 years old to use hosted PLAY through the Licensed Application. Use an account you control, protect its credentials and do not impersonate another person or evade a restriction. An Apple download or Family Sharing relationship does not itself create or share a FreeWIS account, admit someone to PLAY, grant access to the separate browser-only CHAT service or authorize a purchase.

HCT uses the strongest applicable available Apple age safeguards together with FreeWIS's neutral adult affirmation and backend enforcement. The App Store rating and any override must be consistent with the 18-year minimum. Where available or required, FreeWIS requests an age range through Apple's Declared Age Range API, including the supplied declaration source and relevant status. An age range may be declared by a person or guardian or supported by a region-specific check; it is not universal verification. FreeWIS does not ask for exact date of birth by default.

The store rating, Family Sharing, parental approval or a download does not admit a minor to PLAY. On the native age screen, FreeWIS automatically requests the Apple age result once. An unavailable or declined response, ordinary error or ambiguous range does not itself establish adulthood. When FreeWIS has no known-minor result and no positive retained mandatory Apple requirement, the person may explicitly select “I am 18 or older.” FreeWIS records the assurance as self-declared-native-fallback—a self-declared native fallback, not Apple-verified adulthood. A shared adult range also still requires the person's explicit adult declaration.

Known minors are denied access. A positive requirement for age verification or range sharing, parental consent or adult notification remains blocked until it is satisfied and cannot be erased by a later unavailable or failed response. A checkbox cannot override a known-minor result or a mandatory verification requirement. The Privacy Notice explains the minimum age-signal information, purpose, retention and review route. These safeguards do not add standalone CHAT to this PLAY-only release.

Supported sign-in, service admission, service-specific acceptance and any third-party-AI permission remain separate steps. HCT may require renewed acceptance when a material document changes.

5. Synthetic-only public application

The public Licensed Application is a client for HCT's synthetic PLAY demonstration, including the AI assistant within PLAY. Never enter, upload, paste, transmit, create or expose real child-welfare case information or personal information about a real person in PLAY content. Approved sign-in and requested account administration are the limited exceptions; they do not authorize real-data prompts or files.

The Licensed Application is not a government system, an Agency production deployment, a system of record, a child-abuse reporting channel or an emergency service. A configured Agency application is separately distributed and governed by the Agency's agreements and controls.

6. AI assistant and third-party AI

The AI assistant is artificial intelligence, not a human, lawyer, doctor, therapist, caseworker or emergency responder. Output may be inaccurate, incomplete or unsuitable. Do not use it for real-case decisions, professional advice, emergencies or child-abuse reports.

Before the first applicable transmission, FreeWIS must disclose and obtain any required permission for sending a message and relevant response context to Anthropic's API. The Privacy Notice and the versioned in-app disclosure identify the actual information, purposes, provider and retention qualifications. A download, Apple license acceptance or general sign-in is not that permission.

Within PLAY, the AI assistant uses HCT-curated knowledge-base materials and may use the offered tools operating on synthetic demonstration records. It does not search the open web. Check current official sources when currency matters. This PLAY feature does not include standalone CHAT.

7. Acceptable use and protective controls

The Terms' acceptable-use rules apply. You must not misuse the Licensed Application or hosted services, access another person's information, bypass authentication or authorization, conduct intrusive testing without written permission, introduce malicious code, automate or scrape outside an offered feature, evade rate limits, disrupt service, remove notices or resell access.

HCT may use rate limiting, web application firewalls, bot prevention, authentication/access controls, safety or content controls, logging and other technological or administrative measures. A measure may block or delay a request, restrict a function, require renewed authentication or support suspension or termination. HCT may preserve necessary evidence, prevent repeat misuse and pursue remedies available under the applicable agreements and law. These measures do not promise perfect security or uninterrupted service.

8. Updates, availability and changes

HCT may provide or require updates to maintain compatibility, security or service operation. The Licensed Application and hosted services may not be available on every device, operating-system version, language, location or network. HCT does not promise an update, support period or continued feature except as expressly stated in an applicable paid commitment or required by law.

Subject to applicable law, Apple rules, required notice and any existing paid commitment, HCT may change, modify, limit, replace, suspend or discontinue hosted PLAY features, models, interfaces, eligibility, availability and usage allowances and may introduce or change their pricing. No change creates a retroactive charge. A separate affirmative purchase under disclosed purchase terms is required before payment. These rights do not alter GET or an Agency agreement. A later addition of standalone CHAT to the Licensed Application requires a separately identified release, the applicable disclosures and access actions, and any required new acceptance; no such addition is made here.

9. Purchases and subscriptions

The initial United States release is a free download providing PLAY only. It includes no paid CHAT offer, subscription or trial and creates no paid CHAT entitlement. Standalone CHAT is browser-only and outside this native release.

If HCT later offers a paid digital feature through a separately identified release of the Licensed Application, the applicable App Store purchase flow and the presented FreeWIS purchase terms must identify the seller, product, price, currency, billing period, renewal, trial, cancellation, refund, restoration and entitlement before an affirmative purchase. This future-change provision does not offer a paid feature or authorize a charge now.

Apple processes an App Store purchase under its terms. HCT does not receive your Apple Account password or full payment-card number merely because you download or purchase through the App Store. Canceling a subscription, deleting FreeWIS data and deleting an Apple Account are different actions.

10. Maintenance and support

HCT is solely responsible for maintenance and support for the Licensed Application to the extent stated in this Apple EULA, the applicable FreeWIS service or purchase terms, or required by law. Apple has no obligation to furnish maintenance or support for the Licensed Application.

11. Warranty and App Store refund

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSED APPLICATION AND HOSTED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY OR SECURITY. HCT DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE, COMPLETE OR REAL-WORLD-SUITABLE OPERATION.

HCT is solely responsible for any warranty that cannot be effectively disclaimed. If the Licensed Application fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation for the Licensed Application; HCT is responsible for other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to an applicable warranty.

12. Product and regulatory claims

HCT, not Apple, is responsible for addressing claims by you or a third party relating to the Licensed Application or its possession or use, including product liability claims, claims that it fails to conform to an applicable legal or regulatory requirement, and consumer-protection, privacy or similar claims. Nothing limits HCT's liability beyond what applicable law permits.

The Licensed Application does not establish ACF approval, CCWIS status, federal funding eligibility or a reporting result.

13. Intellectual-property claims and upstream components

HCT, not Apple, is responsible for the investigation, defense, settlement and discharge of a third-party claim that the Licensed Application or your possession and use of it infringes that party's intellectual-property rights.

FreeWIS uses upstream components, including LibreChat and Rocket.Chat, under their applicable licenses and notices. Those direct grants remain intact and neither project sponsors nor endorses FreeWIS. You must comply with applicable third-party terms when using the Licensed Application, hosted services, network, identity provider and platform services.

14. Risk allocation

Section 14 of the Terms applies to the Licensed Application and PLAY accessed through it within the common Terms' coordinated public-service allocation. Its defined Protected HCT Parties, release, excluded damages, narrow caused-response costs and third-party indemnity, fault allocation, mitigation, notice/participation and exceptions are incorporated for this subject. The Protected HCT Parties' combined total liability to you arising from the Licensed Application, the Public Services, these documents and your accounts will not exceed US $100, subject to the Terms' fraud, willful/wanton misconduct, gross-negligence and mandatory-law exceptions. This is the same combined limit, not a second or stackable cap.

Apple is not a Protected HCT Party under that definition. Apple's rights as an express third-party beneficiary are stated in Section 18. Applicable consumer rights and Apple's separate refund obligation remain subject to their governing terms and law; no duplicate recovery is intended.

15. Legal compliance and export

You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country and are not listed on a United States Government list of prohibited or restricted parties. You must comply with applicable export-control, sanctions and trade laws and may not use or transfer the Licensed Application when law prohibits it.

16. Termination

This Apple EULA continues until terminated. Subject to applicable law, required notice and any paid or platform commitment, your license terminates if you materially fail to comply with it. HCT may also restrict or end hosted access under the applicable Terms and service agreement. On termination, stop using and remove the Licensed Application as required, subject to lawful backup, platform and records treatment.

Termination of this public-client license does not amend an Agency source license or decide an Agency's operational transition. Ownership, accrued obligations, limited evidence, warranty/risk allocation, claims, law and third-party-beneficiary provisions survive as needed to give them effect.

17. Law and general terms

Colorado law governs without its conflict-of-laws rules, except where mandatory law requires otherwise. Subject to mandatory consumer forum rights, disputes with HCT belong in the state courts located in Jefferson County, Colorado, or, when federal subject-matter jurisdiction exists, the United States District Court for the District of Colorado. Nothing selects a forum for a claim governed solely by a separate agreement with Apple.

If a provision is unenforceable, the remainder continues to the extent permitted by law. Failure to enforce is not a waiver. You may not assign this personal license without HCT's written consent. HCT may assign it with the FreeWIS business subject to applicable law and continuing privacy obligations.

18. Apple third-party beneficiary

You and HCT acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Apple EULA. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce this Apple EULA against you as a third-party beneficiary.
