Effective for FreeWIS native v1 in the United States · Adopted September 16, 2026.

1. HCT and the public services

Hudson Consulting and Training, LLC ("HCT," "we," "us," or "our") is a Colorado limited liability company that operates FreeWIS. These Terms cover the public pages at https://freewis.com, the PLAY demonstration at https://play.freewis.com, standalone CHAT at https://chat.freewis.com, and the GET inquiry process at https://freewis.com/get (together, the "Public Services").

These Terms also govern the Public Services when accessed through any HCT-provided mobile or desktop client that HCT makes available, including an offered iOS, iPadOS, macOS, Windows/PC or Android/Google Play client (an "HCT Client"). Applicable store terms, the platform's standard license or an HCT platform supplement may also govern the client binary, distribution and purchase. A platform term or supplement changes these Terms only for the expressly identified platform-specific subject and does not alter GET or a separate Agency agreement.

The selected initial HCT Client release is a free download available in the United States for PLAY only, including PLAY's AI assistant. Standalone CHAT remains browser-only and no paid CHAT or purchase is included in native v1. Broader references to CHAT or possible later paid features in these Terms do not make them available through that release.

You accept these Terms when you affirmatively select an action that states you accept them. PLAY and CHAT require individual acceptance before access. A GET requester accepts only for that person's own use of the inquiry process. Merely visiting a page or signing in does not constitute acceptance for an agency or another person. The Privacy Notice describes our practices; acknowledgement of that notice is distinct from contractual acceptance or any separately requested processing consent.

HCT is a private company. PLAY is a demonstration using HCT-supplied fictional case data. CHAT is an AI knowledge service configured to answer from HCT-curated knowledge-base materials without open-web search. Neither is a government system, system of record, real-case service or channel for seeking official approval.

2. Separate scopes and agreements

The PLAY Evaluation Access Agreement adds PLAY-specific terms and controls a conflict about PLAY. The CHAT access notice presents CHAT's limitations, processing information and acceptance action; it does not replace these Terms or create a different liability regime. The exact document versions presented at acceptance identify the applicable bundle.

Ordinary public PLAY viewing is open to adults, including people who work for commercial vendors, subject to account, security and acceptable-use requirements. That permission covers ordinary use of the hosted demonstration. It does not permit access to FreeWIS source, nonpublic delivery materials, credentials, repositories or restricted agency work. The GET vendor restrictions in Section 10 govern the agency source path, not a person's independent ordinary public viewing.

A GET inquiry is neither a source license nor a services agreement. Any source delivery, agency production use or HCT services require the applicable separate written agreement. That agreement controls its identified source, work, data and parties; these Public Services Terms do not supply a missing agency risk, funding, patent or data schedule. A separate agreement does not alter an individual's public evaluation terms unless it expressly covers that evaluation and is signed by authorized parties.

3. Adult eligibility, accounts and temporary access

You must be at least 18 years old to use PLAY or CHAT. AI chatbots may not be suitable for minors; these services are for adults only. You accept for yourself, not your employer, an agency, a child or any other person. Follow any employer rules that apply to your evaluation. Your individual acceptance does not commit an agency to payment, indemnity, a license or a procurement decision.

HCT combines the strongest applicable available platform age safeguards with a neutral FreeWIS adult affirmation and server-side access checks. A store rating, download, sign-in or shared device is not by itself proof of adulthood or permission to enter PLAY or CHAT.

For a Google Play client, the release uses Ages 18 and over as its only target audience and enables Restrict minor access, alongside Play Age Signals where available. Google's restriction does not replace FreeWIS checks for people who already installed the app. A returned signal may reflect a verified or declared age range, supervision, unknown status or information not shared; availability also varies. We do not represent every Google account or Play user as age-verified.

For an Apple client, the release uses the age rating and any applicable override consistent with the 18-year minimum, plus Apple's Declared Age Range API where available or required. A declared age range is not necessarily independently verified. FreeWIS does not ask for your exact date of birth by default for this check.

On a native age screen, FreeWIS automatically requests the applicable Apple or Google age result once. An unavailable, declined, not-shared, ambiguous, unsupported or ordinarily failed signal does not itself establish adulthood. When FreeWIS has no known-minor result, no positive retained mandatory platform requirement and no unresolved unclassified prior verification hold, you may explicitly select “I am 18 or older.” FreeWIS records the assurance as self-declared-native-fallback—a self-declared native fallback, not Apple- or Google-verified adulthood. A shared adult range also still requires your explicit adult declaration. On Android, a current not-shared response can permit fallback only when it reports and preserves no positive requirement.

Browser and Windows paths retain neutral adult affirmation and FreeWIS backend enforcement where permitted. Known minors are denied access, and neither parental approval nor a contrary affirmation overrides that exclusion. A positive requirement for age-range sharing, age verification, parental consent or adult notification remains blocked until it is satisfied; a later missing, not-shared or failed response cannot erase it. If you believe an age decision is wrong, contact support for review without sending identity documents in ordinary email. The Privacy Notice describes the limited age-signal information and its use.

Use only an account you control. Sign-in uses the providers offered on the relevant entry screen, including Google and Microsoft for supported HCT-managed accounts. Do not impersonate anyone, share credentials or evade a restriction. HCT may restrict, suspend or end access when reasonably necessary for security, maintenance, misuse prevention, enforcement or law.

An ordinary PLAY access period retires approximately 14 days after admission, unless HCT expressly extends it or ends access sooner. A return through the PLAY entry process requests a new period: current Agreement and Terms acceptance, current Privacy Notice acknowledgement and the required demonstration-context selection apply again. Admission remains subject to review, and a new period does not erase prior restrictions or restore deleted content. Standalone CHAT access is separate; a shared sign-in identity does not itself grant PLAY access or source rights.

4. No real case or personal content

Never enter, upload, paste, transmit or create information about a real person or real child-welfare case in PLAY or CHAT content. This includes names linked to case facts, addresses, contact details, identifiers, health or financial information, abuse or neglect reports, and real-data documents, screenshots, images, audio or exports. This is a material condition of access.

Approved sign-in and requested account-administration information are real and permitted. GET and support may receive the limited professional contact and administrative information they request. Those exceptions do not authorize real-case material, credentials, secrets or sensitive production attachments.

If you discover suspected real information, stop accessing or sharing it and report its location with a minimal description to freewis.support@hudsonct.com. Do not repeat the sensitive content in email. HCT may restrict access, quarantine content, assess required notices and preservation, coordinate affected providers, retain the minimum necessary evidence securely, and lawfully delete the content. Reporting a concern does not itself mean you caused it. The prohibition does not remove HCT's own applicable response duties.

5. Acceptable use and evaluation

You may explore the offered demonstration functions and assess the output using synthetic examples. You must not:

  • use the Public Services unlawfully or for fraud, harassment, threats, discrimination or abuse;
  • use PLAY or CHAT to make or support decisions about a real person or case;
  • access another person's account, nonpublic conversations, data or restricted systems;
  • probe, scan, bypass or conduct intrusive security testing without HCT's prior written authorization;
  • introduce malicious code, disrupt service, evade rate limits or impose unreasonable load;
  • scrape, bulk-extract or automate access except through an offered feature or written authorization;
  • resell access, falsely imply government approval or present demonstration output as a government record; or
  • remove ownership, license, attribution or demonstration notices.

For security reports, send a minimal description and location to freewis.support@hudsonct.com. A report is not authorization for further testing or access to another person's information. Request written authorization for a bounded assessment. If your official evaluation requires retaining an artifact, use an offered export function or request assistance before the evaluation period ends; preserve its demonstration label and handle it under your applicable records duties. This does not authorize bulk extraction or promise indefinite hosting.

When a Public Service lets a participant's message, profile, link, file or artifact become available to another participant, the FreeWIS Community Content Guidelines apply. You must accept the applicable rules before posting shared content. Use the offered Report content, Report user and Block user controls for objectionable Community Content or conduct. Report AI output through the separate Report AI output action. HCT may filter, review, restrict, hide, remove or preserve content and warn, restrict, suspend or terminate an account under those Guidelines and these Terms. A report does not itself prove a violation or promise a particular outcome.

For hosted PLAY and CHAT, HCT may use rate limiting, web application firewalls, bot prevention, authentication and access controls, safety or content controls, security logging, and other technological or administrative measures to protect the services and enforce these restrictions. You must not evade, disable, defeat or interfere with them. A measure may block or delay a request, restrict a function, require renewed authentication, or suspend or terminate access. These measures do not promise perfect security or uninterrupted service.

If HCT reasonably determines that you violated these Terms or an applicable service agreement, HCT may warn you, restrict functions, block requests, suspend or terminate access, preserve necessary evidence, prevent evasion or repeat access, and pursue remedies available under these Terms and applicable law. Enforcement remains subject to applicable law and does not authorize collection or use of information unrelated to the protective purpose.

6. Visibility and content lifetime

PLAY participants use a shared synthetic world. Team messages and artifacts generated against shared demonstration data, including reports and chart views, may be visible to other participants. Names or avatars used for account attribution may be real. Content may be accessible to authorized HCT administrators and providers processing it for the disclosed purposes. Do not treat PLAY as confidential.

Ordinary PLAY period content is deleted or the affected synthetic records are regenerated as part of retirement on the approximately 14-day clock; an expressly extended period follows its revised retirement date. Earlier resets or deletion may occur. Minimal acceptance, admission and security evidence, restricted incident material, legal holds and protected backup copies are treated separately as described in the Privacy Notice. Regeneration of synthetic cases is not a promise that all real account information has been anonymized. HCT does not promise to preserve or recover evaluation content.

Standalone CHAT is subject to its separate conversation-retention disclosure in the Privacy Notice and CHAT access notice. A PLAY reset does not by itself establish deletion of a separate CHAT history or a provider's copy.

7. AI disclosure and safety limits

The AI assistant is artificial intelligence, not a human. AI output may be inaccurate, incomplete or unsuitable. Check the sources and reasoning for evaluation purposes; review does not authorize real-case use. The AI assistant is not a lawyer, doctor, therapist, caseworker or emergency responder, and PLAY and CHAT do not provide professional advice or a professional relationship.

Standalone CHAT is configured to answer from HCT-curated knowledge-base materials and has no general web-search capability. Within PLAY, the AI assistant may also use the synthetic demonstration records and tools offered by FreeWIS. Neither surface checks the open web for current facts. When current law, policy, guidance or events matter, check the cited dates and current official sources outside the service.

Messages and the conversation context needed for a response are sent to Anthropic's API. The Privacy Notice explains HCT's handling and links the provider's practices. Provider documents do not establish a promise of zero retention or that all processing takes place in one region.

PLAY, CHAT and support email are not monitored as emergency or child-abuse reporting channels. If someone is in immediate danger, contact emergency services. Report a child-safety concern to the appropriate local child-protective or law-enforcement agency. For a suicide or mental-health crisis in the United States, call or text **988**. Do not wait for a FreeWIS response.

8. Your content, providers and feedback

You retain any rights you hold in submitted content. You grant HCT a nonexclusive, worldwide, royalty-free permission to host, store, copy, process, transmit and display it only as reasonably needed to operate, secure and support the Public Services, respond lawfully to misuse or incidents, and maintain the limited evidence described in the Privacy Notice. HCT may authorize providers to process content on its behalf for those purposes under applicable protective terms. This grants no general right to publish confidential information or use another person's data without legal authority.

HCT may use information that has been de-identified or aggregated so that it no longer reasonably identifies a person to understand use and improve FreeWIS, subject to applicable law and provider restrictions. This is not permission to repurpose prohibited real-case content or to train a general-purpose AI model on identifiable submissions. Provider safety, legal and retention practices are separately described in the Privacy Notice.

You may voluntarily provide product suggestions that you have the right to share. HCT may use those suggestions to improve its products without payment, but will not identify you publicly as their source without permission. This permission does not transfer agency-owned material or authorize disclosure of personal or confidential information. Do not submit employer-owned contributions unless you have the necessary permission.

9. Intellectual property and upstream projects

HCT and its licensors retain their rights in FreeWIS software, documentation, design, content and marks except as expressly licensed. Public access grants no FreeWIS source or agency-implementation license.

FreeWIS acknowledges LibreChat for its AI conversation foundation and Rocket.Chat for team collaboration components used in the product. Applicable component licenses and required notices govern those components; nothing here restricts rights granted directly by those licenses. Credits identify the components and versions actually used. Neither project sponsors nor endorses FreeWIS. A component's license does not grant access to HCT's restricted source or systems.

Copyright complaints may be sent to freewis.support@hudsonct.com. This contact is not represented as a registered DMCA designated agent.

10. GET and the no-charge source path

Qualifying public child-welfare jurisdictions may request a versioned, jurisdictionally unconfigured FreeWIS source package under a separate no-charge license. The final delivery manifest identifies the included application, SQL/database and knowledge-base materials, versions, dependencies and exclusions. A request does not establish package completeness, approval or a delivery obligation.

The model is agency-led implementation using agency employees, permitted tools and ordinary infrastructure. The agency funds staff, AI access, infrastructure, migration, configuration, integration, security, validation and operations. State-funded implementation is the expected route; federal participation is an optional, separately assessed funding choice. HCT consulting is optional and separately contracted. The source license creates no recurring HCT source-license fee or compulsory HCT services, and includes no promise of future releases, patches, hosting or content updates unless separately agreed.

For this path, an Excluded CCWIS Vendor is a commercial entity other than HCT that has performed compensated CCWIS or SACWIS design, development, implementation, configuration, hosting, maintenance, support, independent verification and validation, quality assurance or advisory work. Supplying only ordinary generally available infrastructure or developer tools, without CCWIS-, SACWIS-, or FreeWIS-specific professional services, does not by itself make a provider excluded. Actual services, personnel access, entity history and involved affiliates must be assessed.

An agency does not qualify while it has an ongoing compensated CCWIS or SACWIS engagement with an Excluded CCWIS Vendor, whether or not that vendor is proposed for FreeWIS. Nor may such a vendor participate in the agency's FreeWIS request, restricted evaluation, planning, implementation or support, or receive source, nonpublic delivery materials, modifications, repository/build/deployment access or related credentials. Ordinary independent public viewing under Section 2 is separate and creates none of those permissions.

Past relationships must be disclosed but do not alone permanently disqualify an agency after the engagement has genuinely ended. Disclose any residual payments, surviving services, support, access or planned work so HCT can determine whether involvement continues. A mere label of "ended" does not settle the facts. HCT's own separately contracted work is permitted. Ordinary infrastructure is permitted when it supplies generally available computing, storage, networking or security, performs no FreeWIS-specific service and gives its personnel no access to restricted materials. Inherent automated storage, transmission or processing alone is not prohibited personnel access. Permitted developer and AI tools remain subject to the source license's account, processing-purpose, access and data-protection requirements; a tool label does not authorize provider personnel or outsourced implementation. Legally required disclosure or access is addressed in the license's government and public-records terms. No commercial implementation-partner program is offered by these Terms.

A preliminary requester may state what is known and mark unresolved facts for verification. Qualification and any license require an authorized agency official's completed review. Do not interrupt necessary services or breach an existing agreement in reliance on an uncertain request. A completed source license will state applicable suspension, termination, source-removal, certification and verification consequences, subject to law and the agency's government terms.

HCT will not enter a source license or deliver FreeWIS code before November 1, 2026. Requests may be reviewed now. November 1 is the earliest possible date, not a promise of approval or delivery on or after that date. Receiving or operating FreeWIS does not establish ACF approval, CCWIS status, federal funding eligibility or a reporting result. Agency production responsibilities and any HCT data access are governed by the applicable separate agreements.

11. Hosted offering changes, future paid features and HCT Clients

HCT may change, modify, limit, replace, suspend or discontinue hosted PLAY or CHAT offerings, features, models, interfaces, eligibility, availability and usage allowances. HCT may introduce or change pricing for hosted PLAY, CHAT or an HCT Client. These choices remain subject to applicable law, applicable store rules, required notice and an existing paid commitment. A material change to accepted service terms follows Section 15. No change creates a retroactive charge, and no download, sign-in, PLAY acceptance or CHAT access action authorizes a charge without a separate affirmative purchase.

This reservation applies only to hosted PLAY, CHAT and HCT Clients. It does not change the GET no-charge source path, impose a fee under an executed source license, or alter an Agency's separate implementation or services agreement.

These Terms establish no current CHAT quota, price, subscription, trial, renewal, refund or paid native-app entitlement. Any paid offering requires its own disclosed scope, price, billing period, renewal, cancellation, refund and entitlement terms and applicable acceptance before a charge. The applicable platform or purchase terms govern billing and store remedies for that transaction. No existing public acceptance automatically purchases an offering.

The common Terms and Privacy Notice apply to the hosted service actually offered through an HCT Client. A platform license or supplement may add binary-license, store, update and purchase provisions. The selected native v1 is a synthetic-only PLAY route, including PLAY's AI assistant; it does not expose standalone CHAT or a paid CHAT purchase. A later client release may add another expressly identified service only after its applicable disclosure, acceptance and store review. No public HCT Client is an Agency production deployment or authorizes real case data. A configured Agency client is separately distributed and governed by the applicable Agency agreements.

12. Export and sanctions

You must comply with applicable export-control, sanctions and trade laws. Do not access, receive or transfer FreeWIS for a person or destination when law prohibits it. HCT may request information needed to assess a proposed delivery; a GET submission does not establish that delivery is legally permitted.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLIC SERVICES AND THEIR CONTENT AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY OR SECURITY. HCT DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE OR COMPLETE SERVICE OR SUITABILITY FOR AN AGENCY, CASE OR LEGAL REQUIREMENT.

14. Public-service risk allocation

"Protected HCT Parties" means HCT and its members, officers, employees, contractors and agents, solely with respect to their conduct in providing or operating the Public Services on HCT's behalf. This does not include a provider's independent business or independent obligations to you.

To the maximum extent permitted by law and subject to the exceptions below, you release the Protected HCT Parties from claims arising from ordinary evaluation risks, including inaccurate AI output, loss of demonstration content and service interruption, including claims based on ordinary negligence.

TO THE MAXIMUM EXTENT PERMITTED BY LAW AND SUBJECT TO THE EXCEPTIONS BELOW, THE PROTECTED HCT PARTIES' COMBINED TOTAL LIABILITY TO YOU ARISING OUT OF OR RELATING TO THE PUBLIC SERVICES, THESE TERMS, THE PLAY AGREEMENT OR CHAT ACCESS WILL NOT EXCEED US $100. This is one combined limit for all Protected HCT Parties for claims by you, across your accounts, documents, events, and Public Services. THE PROTECTED HCT PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY.

Exceptions. The release, cap and exclusions do not apply to fraud, willful or wanton misconduct, gross negligence, or liability or remedies that applicable law does not permit the parties to release, exclude or limit. Nothing waives another person's independent rights, creates an agency indemnity, limits a regulator's authority or shifts responsibility for a party's own unlawful discrimination where law prohibits that allocation. These public limits do not govern separately licensed source or purchased agency services.

If your breach of Section 4 causes prohibited information to enter a Public Service, you are responsible, to the extent permitted by law, for HCT's reasonable, necessary, documented direct costs of containing, investigating and lawfully remediating that entry. Recovery is limited to costs caused by your breach, excludes amounts attributable to a Protected HCT Party's own breach or fault, and permits no duplicate recovery. A good-faith report alone creates no payment obligation; HCT will reasonably mitigate response costs.

To the extent permitted by law, you will indemnify the Protected HCT Parties for third-party claims only to the extent caused by your material breach of Sections 4 or 5, unlawful conduct, or submission of content without the required rights. This covers amounts established by a final judgment or a settlement you approve in writing, and reasonable, documented legal costs attributable to that covered claim. It excludes loss caused by a Protected HCT Party's own breach or fault and any duplicate recovery. HCT must give prompt notice of the claim, with delay reducing your obligation only to the extent it materially prejudices you, and provide reasonable information and an opportunity to participate. HCT controls its defense; this clause imposes no duty to advance costs or assume a defense before responsibility is established. No settlement may impose an obligation on you without your written agreement.

The Protected HCT Parties may enforce this Section 14 as intended beneficiaries. Otherwise these Terms create no intended third-party beneficiary rights. That statement does not extinguish anyone's independent rights under law.

15. Changes and records

Each adopted version shows its version and effective date. Material changes to the terms governing PLAY or CHAT require review and affirmative acceptance before continued access under the changed terms. New acceptance is prospective and does not rewrite earlier acceptance evidence or extend an access period by itself. Other changes will be presented through the affected service; a new posting alone does not retroactively alter an existing agreement.

HCT retains the exact accepted document bundle and makes version-specific copies available through the links presented with acceptance. For PLAY, HCT attempts to email a PDF of the exact accepted Agreement, with immutable links to that Agreement and the accepted Terms and acknowledged Privacy Notice, plus an accessible text equivalent. Mail delay, filtering or delivery failure does not invalidate an otherwise properly recorded acceptance. You may retain the copies or request them from support. Email submission is not proof of delivery.

16. Ending access and assignment

You may stop using the Public Services at any time. HCT may end or restrict access as described above. Ending access does not erase applicable acceptance evidence or a lawful preservation obligation. Content permissions survive only as needed for the limited retention and lawful purposes stated here; ownership, disclaimers, risk allocation, accrued obligations and dispute terms survive to the extent needed to give them effect.

You may not transfer your account or these Terms without HCT's written consent. HCT may assign these Terms in a merger, reorganization or transfer of the FreeWIS business, subject to applicable law and privacy obligations. An assignment does not broaden permitted uses of personal information.

17. Law, courts and general terms

Colorado law governs without its conflict-of-laws rules, except where applicable mandatory law requires otherwise. Subject to mandatory forum rights and any separate agreement governing its own subject, disputes belong in the state courts located in Jefferson County, Colorado, or, if federal subject-matter jurisdiction exists, the United States District Court for the District of Colorado. The parties consent to those courts' personal jurisdiction. These Terms require no arbitration and contain no class-action waiver.

If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision is not a waiver. These Terms and the PLAY Agreement where applicable constitute the public-service agreement for their stated subjects; separate executed agreements control their stated source, work and parties. The Privacy Notice describes practices and is acknowledged, not incorporated as a separate contract. That distinction does not waive applicable privacy duties or rights.
